If you bought a car, trailer, ATV, boat, or snowmobile in another state and already paid sales tax on it there, New York doesn’t make you pay the full tax rate again when you register it here. That’s what Form DTF-804 is for. Issued by the New York State Department of Taxation and Finance, this form lets you claim a credit for the sales tax you already paid to another state, so you’re not taxed twice on the same purchase.
The official title is “Statement of Transaction — Claim for Credit of Sales Tax Paid to Another State for Motor Vehicle, Trailer, All-Terrain Vehicle (ATV), Vessel, or Snowmobile.” It’s a straightforward credit claim, but it’s often misunderstood or skipped entirely by people who end up overpaying at the DMV counter.
Who Needs This Form
You need DTF-804 if you:
- Purchased a motor vehicle, trailer, ATV, vessel (boat), or snowmobile in another state or jurisdiction.
- Paid sales tax to that state at the time of purchase.
- Are now registering or titling that item in New York State.
This applies mainly to new residents moving to New York with a vehicle they bought elsewhere, or anyone who purchased a vehicle out of state before bringing it home to register. Dealers and private buyers alike can use it, as long as proof of the original tax payment exists.
When and Where It’s Used
You submit Form DTF-804 at the time you register the vehicle, trailer, ATV, vessel, or snowmobile with the New York State DMV, or with a dealer handling the registration on your behalf. The DMV uses this form to calculate how much New York sales tax you still owe, if any, after crediting what you already paid in the other state. If the tax rate you paid elsewhere is equal to or higher than New York’s rate, you may not owe any additional tax. If it was lower, you’ll owe the difference.
Keep in mind this credit only applies to sales tax, not registration fees, title fees, or other state-specific charges. Those are separate and still payable to New York regardless of what you paid elsewhere.
What You’ll Need to Fill It Out
The form asks for basic identifying information about the buyer, the seller, and the vehicle or vessel itself — year, make, model, VIN or hull identification number, and purchase price. You’ll also need to document exactly how much sales tax was paid to the other state and on what date. Supporting documentation, like a bill of sale or the out-of-state tax receipt, is typically required alongside the form when you bring it to the DMV.
Form DTF-804 is not a fillable PDF — you’ll need to print it out and complete it by hand. Make sure your handwriting is legible, since errors or illegible entries can delay processing or result in the DMV asking you to resubmit. Once printed and signed, bring the form along with your other registration paperwork to a DMV office or authorized agent.
A Few Practical Notes
This form is specific to vehicles, trailers, ATVs, vessels, and snowmobiles — it doesn’t apply to other types of purchases or tax credits. If you’re dealing with other New York tax or business registration paperwork, it’s worth checking related guides like the Application for Registration as a Chain Store or its companion instructions for Form CG-80, since New York’s tax and registration forms often work together in ways that aren’t obvious at first glance.
If you’re in the transportation or livery business, you might also want to look at Form IT-236-I instructions, which cover a separate tax credit available to taxicab and livery vehicle owners in New York.
Double-check the current sales tax rate in the state where you originally bought the vehicle versus New York’s local rate, since the credit is based on actual tax paid, not just a flat assumption. Bringing clear documentation the first time you visit the DMV will save you a return trip.
