Form IT-285 is the New York State Department of Taxation and Finance’s application for taxpayers who filed a joint personal income tax return and now find themselves on the hook for a tax debt, penalty, or interest that really belongs to their spouse or ex-spouse. If you signed a joint return but didn’t know about (or benefit from) errors, unreported income, or improper deductions your spouse made, this form is the mechanism for asking New York to separate you from that liability.

What This Form Actually Does

New York, like the IRS, allows married couples to file joint returns, which means both spouses are jointly and individually responsible for the full tax bill, even if only one person earned the income or made the mistake. Form IT-285 asks the state to grant one of three types of relief:

  • Innocent spouse relief – you didn’t know, and had no reason to know, that your spouse understated the tax owed.
  • Separation of liability – available if you’re divorced, legally separated, widowed, or have lived apart from your spouse for at least 12 months, allowing the debt to be divided between you.
  • Equitable relief – for situations that don’t qualify under the first two categories but where holding you responsible would be unfair given the full facts.

The form walks through your marital history, income, and financial situation so the Tax Department can determine which category, if any, applies to your case.

Who Should File It

This form is meant for people who filed jointly with a spouse (current or former) and are now facing a tax bill, collection notice, or audit result they believe is unfair to hold against them personally. Common scenarios include a spouse hiding income, claiming false deductions or credits, or simply not disclosing financial problems before the return was signed. It’s worth noting that Form IT-285 is different from Form IT-280, the Nonobligated Spouse Allocation, which is used when your refund is being seized to cover your spouse’s debt rather than when you’re being pursued for additional tax owed. If your issue is a refund offset instead of a new liability, IT-280 is the right form, not IT-285.

When to Submit the Request

You can file Form IT-285 as soon as you receive a bill, notice, or proposed assessment tied to a joint return you believe shouldn’t be your responsibility. There’s no need to wait until enforcement action starts, and in fact filing earlier gives the department more time to review your circumstances before any collection steps move forward. Generally, you should request relief within two years of the first collection activity against you for the tax debt in question, so it’s not something to put off once you get a notice.

How to Fill It Out and Submit It

The version revised in December 2024 is a fillable PDF, so you can type your responses directly into the form using a computer or the Adobe Acrobat Reader app rather than filling it out by hand. You’ll need to provide identifying information for both spouses, details about the tax year and liability in dispute, and a written explanation of why you qualify for one of the three types of relief. Be specific about what you knew, when you knew it, and how the return was prepared — vague statements tend to slow down processing or lead to denials.

Supporting documentation matters here. Divorce decrees, separation agreements, correspondence showing you weren’t involved in financial decisions, or proof you didn’t benefit from the unreported income can all strengthen your case. Once completed, the form gets mailed to the address listed in the instructions; there’s currently no online submission option for this particular request.

If your joint filing situation also involves an extension you filed earlier in the year, it doesn’t affect your eligibility for innocent spouse relief, but it’s useful to keep your paperwork straight if you originally requested more time using Form IT-370. Processing times vary depending on the complexity of the case and whether the department needs additional information from you or your spouse.
