Form NYS-45 is the quarterly return that New York State employers use to report income tax withheld from employee wages, wage and employment details for each worker, and unemployment insurance contributions. Instead of filing three separate returns for these obligations, the New York State Department of Taxation and Finance combined them into one form, which is why it’s officially called the Quarterly Combined Withholding, Wage Reporting, and Unemployment Insurance Return.
The version dated 1/26 is the current revision, and it’s an AcroForm PDF, meaning you can type your entries directly into the file on a computer before printing or submitting it. This saves time compared to filling out a paper form by hand and reduces the chance of illegible entries.
Who Needs to File Form NYS-45
Any employer who pays wages to one or more employees in New York State generally has to file this return, regardless of whether the business is a corporation, partnership, LLC, or sole proprietorship. This includes employers who withhold New York State, New York City, or Yonkers income tax, as well as those liable for state unemployment insurance contributions.
Even if an employer had no payroll during a particular quarter, a return may still need to be filed to report that fact, unless the state has specifically waived the requirement for that employer. Household employers and certain agricultural employers follow slightly different rules, so it’s worth checking the instructions that accompany the form if your business falls into one of those categories.
When the Form Is Due
Form NYS-45 is filed quarterly, with due dates falling on the last day of the month following the end of each calendar quarter. That means returns are typically due April 30, July 31, October 31, and January 31. Employers who are also subject to the Metropolitan Commuter Transportation Mobility Tax may need to coordinate this filing with related obligations covered under Form MTA-305, since both returns deal with employer payroll reporting on a quarterly basis.
What Information Goes Into the Form
The return asks for total remuneration paid during the quarter, the amount of New York State, New York City, and Yonkers tax withheld, and detailed wage reporting for each employee, including gross wages and Social Security number. On the unemployment insurance side, employers report total remuneration subject to contributions, calculate the amount due based on their assigned rate, and reconcile any prior payments or credits.
Employers with a large number of employees often file wage reporting information electronically rather than listing every worker on the paper form itself, since the state’s online filing system can handle bulk uploads more efficiently. Smaller employers with just a handful of workers may find it simpler to complete the fillable PDF directly.
How to Get and Complete the Form
The official NYS-45 is available as a fill-in PDF directly from the New York State Department of Taxation and Finance. Because it’s an AcroForm, you can open it in most PDF readers, click into each field, and type your figures without needing separate software. Once completed, double-check totals for withholding and unemployment insurance contributions before submitting, since mismatched numbers are one of the most common reasons returns get flagged for review.
Many employers file this return online through the Department’s Withholding Tax Web File system, which automatically calculates certain totals and reduces errors. Paper filing is still accepted, but electronic submission is generally faster and gives you immediate confirmation that the state received your return.
If your business also deals with other New York tax and reporting forms, it helps to keep your paperwork organized across the board. For example, individuals receiving retirement distributions might need to reference Form IT-1099-R when reconciling state tax withholding on pension income, while property owners managing multiple accounts sometimes need Form RP-923 to request duplicate tax bills be sent to a third party. Keeping these related filings straight makes quarterly payroll reporting less of a headache when tax season rolls around.
Late filing or late payment of amounts due with Form NYS-45 can trigger penalties and interest, so it’s worth marking the quarterly deadlines on a calendar well in advance. If you’re unsure whether your business meets the filing threshold for a given quarter, reviewing the current instructions from the Department of Taxation and Finance before the deadline is the safest way to avoid an unnecessary penalty notice later.
