Form CG-5 is issued by the New York State Department of Taxation and Finance and is officially titled the Nonresident Agent Cigarette Tax Report. It’s a specialized filing used by cigarette agents who are located outside New York State but who ship, sell, or distribute cigarettes into New York for resale. Because these businesses don’t operate within the state, New York requires a dedicated reporting mechanism to track cigarette stamp purchases, sales, and inventory movement across state lines.
If you’re not familiar with how New York regulates the cigarette trade, it helps to know that the state runs one of the most tightly controlled cigarette tax stamp systems in the country. Any business licensed as a cigarette agent — whether based in New York or elsewhere — has to account for every pack that moves through its hands. Form CG-5 exists specifically to capture that accounting for agents operating from outside New York’s borders.
Who Needs to File Form CG-5
This form applies to nonresident cigarette agents: businesses licensed by New York State to affix tax stamps to cigarette packages but whose physical operations are located in another state. These agents typically purchase cigarettes wholesale, apply New York tax stamps, and then distribute the stamped product to retailers or other licensed dealers within New York.
Because they’re not physically present in New York, the state can’t easily verify their inventory and sales activity through routine in-state audits. Form CG-5 fills that gap by requiring these agents to self-report their cigarette transactions on a recurring basis, giving the Department of Taxation and Finance the paper trail it needs to confirm that tax stamps are being used and accounted for correctly.
If you hold a nonresident agent license and deal in cigarettes destined for New York retailers, this is a form you’ll need to file as part of your ongoing compliance obligations. It works alongside other cigarette compliance filings, such as the Cigarette Stamping Agent Certification of Compliance, which stamping agents use to certify they’re following Tax Law Article 20 requirements.
When Form CG-5 Is Used
Nonresident agents typically file this report on a regular schedule set by the Department of Taxation and Finance, reflecting cigarette stamp purchases and sales activity for the reporting period. The report documents how many stamps were bought, how many were applied to product shipped into New York, and what remains in inventory. This creates a running record that tax examiners can cross-reference against stamp purchase records and wholesale sales data.
Timely and accurate filing matters here. Nonresident agent status is a privilege extended by New York, not a right, and failing to file or submitting inconsistent numbers can jeopardize that license. Agents who also deal with use tax obligations on cigarettes brought into New York outside the normal stamping process should be aware of related filings like the Cigarette Use Tax Return, which covers a different but related area of cigarette taxation.
How to Get and Complete Form CG-5
Form CG-5 is available directly from the New York State Department of Taxation and Finance website as a PDF. One important detail: this form does not support digital data entry. It must be printed out and filled in by hand before being mailed or submitted according to the instructions on the form itself. There’s no option to type your entries into the PDF and save it electronically, so plan to print a physical copy in advance of your filing deadline.
When completing the form, have your stamp purchase invoices and sales records on hand, since you’ll need exact figures for stamps acquired, stamps applied, and any remaining inventory. Double-check your agent license number and reporting period before submitting, as errors in these fields are a common cause of processing delays.
Agents dealing with cigarette brands subject to the Tobacco Master Settlement Agreement should also be familiar with Form CG-30, which certifies MSA compliance status for products being sold in New York. Keeping these related filings organized together makes it easier to stay current with the state’s cigarette tax reporting requirements overall.
