Form IT-212, Investment Credit, is issued by the New York State Department of Taxation and Finance for taxpayers who purchase, build, or lease qualified property used in manufacturing, research, or certain other business activities within the state. If your business invested in equipment, buildings, or other qualified property during the tax year, this form is how you claim a credit against your New York State tax liability for that investment.
The credit is meant to encourage businesses to expand operations in New York by offsetting some of the cost of new property placed in service. It applies mainly to corporations, partnerships, and individual taxpayers who operate a business subject to New York tax and who acquired property that meets the definition of “qualified property” under the state’s tax law. This generally includes tangible property used in production, manufacturing, farming, or certain research and development activities, as well as some rehabilitated or reconstructed buildings.
Who Needs to File Form IT-212
You need this form if you’re a business owner, sole proprietor, partner, or shareholder in an S corporation that acquired qualifying property and wants to reduce state tax owed through the investment credit. It’s also used by taxpayers claiming the related Employment Incentive Credit, which provides an additional credit when a business increases its employment levels after claiming the investment credit in a prior year.
Individuals who receive a share of investment credit through a partnership or S corporation also use IT-212 to claim their portion on their personal New York State return. In these cases, the credit passes through from the entity to the individual, and the form calculates how much of that credit can actually be applied based on the taxpayer’s tax liability limits.
When to Use This Form
Form IT-212 is filed with your annual New York State income tax return for the tax year in which the qualified property was placed in service, or in later years if you’re carrying forward unused credit. New York allows unused investment credit to be carried forward for a set number of years if your tax liability isn’t large enough to absorb the full credit in the year it’s earned, so many filers end up using this form repeatedly across multiple tax years.
