Form RP-485-a-C, issued by the New York State Department of Taxation and Finance, is the Certification of Eligibility used under the Residential-Commercial Urban Exemption Program. This program gives partial property tax exemptions to owners who convert, improve, or construct mixed-use buildings that combine residential units with commercial space in eligible urban areas of New York State. The form itself doesn’t grant the exemption — it certifies, at the local level, that a project meets the physical and use requirements set by the municipality’s local law adopting the program.
The Residential-Commercial Urban Exemption Program falls under Real Property Tax Law Section 485-a, which allows cities, towns, and villages to offer tax incentives for rehabilitating or building structures that mix housing with retail, office, or other commercial uses. Not every municipality participates — local governments have to opt in through their own legislation, and the specific percentages, exemption schedules, and eligible zones can vary from one place to another. Form RP-485-a-C is the document that confirms a specific project satisfies those locally adopted conditions before any tax benefit is applied.
Who Needs This Form
Property owners, developers, or contractors involved in mixed-use construction or renovation projects in a participating municipality are the ones who typically need RP-485-a-C. This includes owners converting an old commercial building into a structure with ground-floor retail and upper-floor apartments, or developers constructing new buildings designed from the start to serve both residential and commercial tenants. Local assessors and building or planning departments also rely on this form as part of their review process, since it’s usually the assessor’s office — sometimes working alongside a building or code enforcement officer — that signs off on the certification.
If your project is purely residential, this isn’t the right form. Similar exemption programs exist for residential-only rehabilitation or investment projects, and those use different applications. For example, property owners working on residential improvement projects in certain municipalities may instead need Form RP-485-L for residential property improvements, while investment-focused residential rehab projects sometimes fall under Form RP-485-I for residential investment real property. RP-485-a-C is specifically for projects with a genuine commercial-residential mix, not one or the other.
When the Form Is Used
Form RP-485-a-C is typically submitted after the local legislative body has approved the exemption program in that municipality and after the property owner has begun or completed the qualifying construction or conversion work. Because exemption benefits are usually tied to the date construction starts or is completed, timing matters. Owners should check with their local assessor’s office early in the planning process to confirm the municipality participates in the program, understand the certification requirements, and find out submission deadlines relative to the assessment roll.
How to Get and Complete the Form
The form is available as a fillable PDF directly from the New York State Department of Taxation and Finance website, and it can be completed digitally before printing for signature. It asks for property identification details, a description of the residential and commercial components of the project, construction dates, and certification statements confirming the work meets the local law’s requirements. Because the certifying authority is usually a local official rather than the state, applicants should route the completed form through their municipal assessor or building department rather than sending it directly to Albany.
Property owners working on similar commercial-adjacent exemption programs, such as branch bank facilities in designated development districts, might also want to look at Form RP-485-F for branch bank tax exemptions, which follows a comparable local certification structure. Keeping copies of the completed RP-485-a-C, along with any supporting construction records, is worthwhile in case the exemption is reviewed in later assessment cycles.
