Form DTF-801 is issued by the New York State Department of Taxation and Finance and lets an enrolled member of a New York Nation or tribe claim exemption from state and local sales tax on certain property or services. The exemption only applies when the item or service is actually delivered to the purchaser on a qualified reservation. It’s a narrow but useful exemption, and vendors need this certificate on file to justify not collecting sales tax on the transaction.
The certificate is meant for individual tribal members, not for tribal governments or businesses operating on reservation land under a separate exemption category. If you’re an enrolled member buying a car, appliance, furniture, or other tangible property, and that property is being delivered to you on the reservation where you reside, this form documents your eligibility for the exemption at the point of sale.
Who Needs to Use This Form
You need Form DTF-801 if you are an enrolled member of a New York State-recognized Nation or tribe and you’re purchasing property or services that will be delivered to you on qualified reservation land. The seller — whether a car dealership, furniture store, appliance retailer, or service provider — is the one who keeps this certificate as proof that the sale was properly exempted from sales tax.
Sellers should not accept this form for transactions where delivery happens off the reservation, even if the buyer is an enrolled tribal member. The exemption is tied specifically to the location where the property or service is delivered, not simply to the buyer’s tribal enrollment status. If delivery occurs at the seller’s location off the reservation, or if the buyer picks the item up somewhere else, the exemption generally doesn’t apply and regular sales tax rules take over.
When This Form Is Used
The form comes into play at the time of purchase. The buyer fills it out and presents it to the seller before or at the time the sale is finalized. The seller then retains the completed certificate in their records in case the Department of Taxation and Finance later asks for documentation supporting the tax-exempt treatment of the sale.
Common situations where DTF-801 gets used include vehicle purchases delivered to a reservation address, home appliance or furniture deliveries, and certain contracted services performed on reservation property. Because the form requires specific details about the buyer, the tribe or nation of enrollment, and the delivery location, it’s not something you fill out casually — it needs to match the actual circumstances of the sale.
How to Get and Fill Out Form DTF-801
This form is not fillable online. You’ll need to download the PDF, print it, and complete it by hand. There’s no digital submission option through the state’s website, so plan on physically printing a copy before your transaction.
When filling it out, you’ll need to provide identifying information about yourself as the purchaser, your tribal enrollment details, a description of the property or service being purchased, and confirmation of the reservation delivery address. Both the buyer and seller typically need to review the form to make sure everything lines up correctly, since an incomplete or inaccurate certificate can be rejected later during an audit.
Keep in mind this exemption certificate is separate from other refund and exemption processes used for fuel, wireless surcharges, or other transaction-specific claims. If you’re dealing with government fuel purchases, for example, you’d be looking at something like Form FT-504 instead, which covers fuel tax refunds for government entities. Similarly, if a government fuel card was used for purchases, Form FT-505 handles that specific refund category, and unrelated surcharge refunds for wireless services fall under Form AU-100.
Sellers should hold onto completed DTF-801 certificates for as long as their standard recordkeeping requirements dictate under New York tax law, since these documents may be requested during a routine sales tax audit.
