Form ST-129, issued by the New York State Department of Taxation and Finance, is the certificate that government employees present to hotels and other lodging establishments to avoid paying New York State and local sales tax on room charges while traveling on official business. Without this form, hotels are required to charge the standard occupancy tax, and travelers would have to seek a refund later — a much slower and more cumbersome process.
The exemption applies specifically to employees of the United States government, New York State, and its political subdivisions (counties, cities, towns, villages, and school districts) when they are staying at a hotel or motel for work-related purposes and the lodging is being paid for directly by the government entity, either through a government credit card, check, or direct billing arrangement. If the employee pays out of pocket and expects reimbursement later, this exemption generally does not apply — the payment method matters as much as the traveler’s employment status.

This form is meant for two parties working together at check-in: the traveling government employee and the hotel operator. The employee fills out the certificate to confirm their status and the official nature of the trip, while the hotel keeps the completed form on file to justify not collecting sales tax on that stay. It’s not something submitted to the Tax Department directly — it functions as documentation between the guest and the lodging establishment.
Federal employees, New York State employees, and employees of local governments within New York are all eligible, provided the stay is tied to their job duties and paid for through official government funds. Employees of other states’ governments, even if traveling through New York on official business, typically don’t qualify under this particular exemption.
When to Use It
Form ST-129 should be presented at the time of check-in, not after the fact. Hotels need the completed certificate before or during the stay to properly exclude the tax from the bill. If a traveler forgets to bring it, some properties may still charge sales tax and leave the employee to pursue a refund claim afterward, which is why it’s worth keeping a signed copy on hand for any trip involving overnight government travel.
The version dated 3/25 is the current revision and should be the one used going forward, as the Tax Department periodically updates the form’s language and formatting even when the underlying exemption rules stay the same.
