Form 3510 is a California Franchise Tax Board form that lets individuals and fiduciaries claim a credit for alternative minimum tax (AMT) paid in a prior year. If you got hit with California AMT in an earlier tax year because of certain deductions or preference items, this form is how you recover some of that money once your tax situation returns to normal and you’re back under regular tax rules.
The idea behind this credit is simple, even if the math on the form isn’t. AMT is meant to catch taxpayers who reduce their regular tax liability too much through deductions, exemptions, or other adjustments. But some of those AMT adjustments are just timing differences — they don’t permanently reduce your tax, they just shift when you pay it. Form 3510 exists to give that money back to you in a later year, once the timing difference has worked itself out.
Who Needs to File Form 3510
You need this form if you paid California AMT in a previous tax year due to deferral items — things like depreciation adjustments, incentive stock options, or certain passive activity losses — rather than exclusion items like state tax deductions. Only the deferral-based portion of prior AMT generates a credit you can claim going forward.
This applies to:
- Individual taxpayers who paid California AMT in a prior year
- Fiduciaries handling estates or trusts that were subject to AMT
- Anyone carrying forward an AMT credit from previous years that hasn’t been fully used
If you’ve never paid California AMT before, or if all your prior AMT came from exclusion items (state and local tax deductions being the most common example), you likely don’t have a credit to claim on this form.
When You Use This Form
Form 3510 gets filed alongside your California income tax return for the year you’re claiming the credit — in this case, the 2024 tax year. You’ll need your prior year California returns and AMT calculations on hand, since the form requires you to track the credit carryforward amount from year to year. If you’ve been carrying an unused AMT credit for several years, you’ll need those historical figures to calculate what’s still available.
The credit isn’t a one-time thing. If you don’t use all of it in the current year because your regular tax liability is too low, the unused portion carries forward to future years. This makes it worth tracking even if you can’t claim the full credit right now.
How to Get and Fill Out Form 3510
The form is available directly from the California Franchise Tax Board as a fillable PDF, meaning you can type your figures directly into the AcroForm fields rather than printing it out and writing by hand. That said, the calculations behind those fields aren’t always straightforward — you’re essentially recomputing a simplified AMT calculation for the current year and comparing it against what you’d owe under regular tax rules.
Before you start, gather your prior year Schedule P (Alternative Minimum Tax and Credit Limitations) forms, since those show the AMT adjustments that generated your credit in the first place. You’ll also need your current year California tax return figures, since the credit is limited by your regular tax liability minus certain other credits.
People dealing with California-specific tax credits often run into other state forms that require similar attention to detail. If you’re also handling a nonprofit’s filings, the California Form 199 exempt organization return follows a similarly structured process. And if your tax situation spans multiple states, comparing how other states handle specialized credits — like New York’s geothermal energy credit or the nonresident cooperative unit estimated tax form — can help you understand how differently each state structures its tax credit mechanics.
Fiduciaries filing on behalf of a trust or estate should pay close attention to the instructions regarding how the credit passes through to beneficiaries versus staying with the trust itself, since this affects which return the credit actually appears on.
